Jazz Player Radio is just one casualty of a bill passed by Congress
updating America's copyright laws. Rather than paying a royalty rate
similar to over the air radio stations, all internet streaming and
downloads were essentially considered to be equivalent, meaning
internet radio stations have to pay royalties as if they are selling
individual songs. The bill goes into effect May 15 and will be
retroactive to January 1. Many radio stations objected to the
passage of this bill, stating that fees greater than 100% of their
gross receipts will have to be paid to stay on the air. Large
stations will have bills in excess of a million dollars a day.
NPR convinced Congress to hold hearings and the bill is being
reconsidered. Also, within the past week, the Supreme Court ruled
against ASCAP in a case, the decision stating that they cannot
collect royalties for digital streaming. THese events are in JPR's
favor and should lead to making the internet a favorable environment
for digital streaming.
Internet commerce for the entertainment industry is very new.
Royalties do need to be paid and the creative works of our favorite
artists do need to be protected. I believe, however, that the
current legislation was over the top and, by the end of the month,
will shut down virtually all internet radio in America. Once this
and future bills are haggled out, hopefully, JPR and other internet
music providers will return.
