On the flip side, I've also heard some jazz soloists use pedal tones in
their solos quite effectively (as well as classical soloists - i.e, low Eb
in the Hummel).  Yet, the range of the horn is technically E concert below
middle C...

It's about music, not some pre-determined, confined range of the instrument.
Clearly, this whole assertion is just nonsense.  

Let's move on...
